{"id":2097,"date":"2025-09-30T14:27:39","date_gmt":"2025-09-30T14:27:39","guid":{"rendered":"https:\/\/www.alveria.it\/?p=2097"},"modified":"2025-09-30T14:29:11","modified_gmt":"2025-09-30T14:29:11","slug":"directive-970-23-sur-la-transparence-des-remunerations-et-la-protection-des-donnees-un-equilibre-necessaire-2097","status":"publish","type":"post","link":"https:\/\/www.alveria.it\/fr\/2025\/09\/30\/direttiva-970-23-sulla-trasparenza-retributiva-e-protezione-dei-dati-un-bilanciamento-necessario-2097\/","title":{"rendered":"Directive 970\/23 sur la transparence des r\u00e9mun\u00e9rations et la protection des donn\u00e9es : un \u00e9quilibre n\u00e9cessaire"},"content":{"rendered":"<p data-start=\"110\" data-end=\"685\">La <strong data-start=\"113\" data-end=\"140\">Directive (UE) 970\/23<\/strong> introduit des obligations strictes en ce qui concerne <strong data-start=\"185\" data-end=\"212\">transparence des salaires<\/strong>dans le but de <strong data-start=\"233\" data-end=\"262\">r\u00e9duire l'\u00e9cart de r\u00e9mun\u00e9ration entre les hommes et les femmes<\/strong> et <strong data-start=\"265\" data-end=\"317\">renforcer le droit \u00e0 l'\u00e9galit\u00e9 de traitement<\/strong>. Parmi les principales innovations, on peut citer le <strong data-start=\"352\" data-end=\"452\">le droit des travailleurs \u00e0 recevoir des informations sur les niveaux de salaires moyens, ventil\u00e9s par sexe<\/strong>pour des cat\u00e9gories de travailleurs effectuant le m\u00eame travail ou un travail de valeur \u00e9gale (<strong data-start=\"540\" data-end=\"550\">Article 7<\/strong>), et le<strong data-start=\"557\" data-end=\"671\">obligation pour les employeurs d'au moins 100 salari\u00e9s d'\u00e9tablir des rapports p\u00e9riodiques sur l'\u00e9galit\u00e9 de r\u00e9mun\u00e9ration<\/strong> (<strong data-start=\"673\" data-end=\"683\">Article 9<\/strong>).<\/p>\n<p data-start=\"687\" data-end=\"1349\">Toutefois, ces obligations soul\u00e8vent des questions importantes en ce qui concerne le cadre de l'accord de l <strong data-start=\"769\" data-end=\"802\">protection des donn\u00e9es personnelles<\/strong>r\u00e9gi par la <strong data-start=\"821\" data-end=\"857\">R\u00e8glement (UE) 2016\/679 (GDPR)<\/strong>. En effet, la divulgation des donn\u00e9es salariales peut conduire \u00e0 <strong data-start=\"919\" data-end=\"949\">risques d'identifiabilit\u00e9<\/strong>en particulier dans les contextes d'entreprise de <strong data-start=\"989\" data-end=\"1011\">petite taille<\/strong> ou dans le <strong data-start=\"1018\" data-end=\"1051\">r\u00f4les hautement sp\u00e9cialis\u00e9s<\/strong>. Dans ce cas, la combinaison des variables (<strong data-start=\"1097\" data-end=\"1134\">r\u00f4le, d\u00e9partement, sexe, anciennet\u00e9<\/strong>) pourrait rendre les travailleurs individuels reconnaissables, ce qui pourrait \u00eatre en contradiction avec les principes du <strong data-start=\"1240\" data-end=\"1289\">la minimisation (article 5, paragraphe 1, point c), du RGPD)<\/strong> et <strong data-start=\"1292\" data-end=\"1348\">limitation de la finalit\u00e9 (article 5, paragraphe 1, point b))<\/strong>.<\/p>\n<p data-start=\"1351\" data-end=\"1831\">La directive elle-m\u00eame reconna\u00eet la n\u00e9cessit\u00e9 d'un \u00e9quilibre : la<strong data-start=\"1414\" data-end=\"1425\">Article 19<\/strong> pr\u00e9cise en effet que les obligations de transparence doivent \u00eatre mises en \u0153uvre <strong data-start=\"1498\" data-end=\"1601\">\" respectant le droit \u00e0 la protection des donn\u00e9es \u00e0 caract\u00e8re personnel tel que pr\u00e9vu par le r\u00e8glement (UE) 2016\/679 \".<\/strong>. Cela implique un double engagement de la part des employeurs : <strong data-start=\"1658\" data-end=\"1714\">garantir le droit \u00e0 l'information des travailleurs<\/strong> et, en m\u00eame temps, <strong data-start=\"1731\" data-end=\"1830\">appliquer des mesures de protection appropri\u00e9es pour emp\u00eacher la diffusion indue de donn\u00e9es identifiables<\/strong>.<\/p>\n<p data-start=\"1833\" data-end=\"1880\">Les mesures pratiques comprennent<\/p>\n<ul data-start=\"1882\" data-end=\"2242\">\n<li data-start=\"1882\" data-end=\"1951\">\n<p data-start=\"1884\" data-end=\"1951\"><strong data-start=\"1884\" data-end=\"1924\">Anonymisation ou pseudonymisation<\/strong> des donn\u00e9es salariales ;<\/p>\n<\/li>\n<li data-start=\"1952\" data-end=\"2062\">\n<p data-start=\"1954\" data-end=\"2062\"><strong data-start=\"1954\" data-end=\"1985\">Seuils minimaux de num\u00e9rosit\u00e9<\/strong> dans les rapports, en \u00e9vitant les publications o\u00f9 le groupe est trop petit ;<\/p>\n<\/li>\n<li data-start=\"2063\" data-end=\"2134\">\n<p data-start=\"2065\" data-end=\"2134\"><strong data-start=\"2065\" data-end=\"2103\">Agr\u00e9gation par tranche de salaire<\/strong> plut\u00f4t qu'une divulgation en temps utile ;<\/p>\n<\/li>\n<li data-start=\"2135\" data-end=\"2242\">\n<p data-start=\"2137\" data-end=\"2242\"><strong data-start=\"2137\" data-end=\"2166\">Politique de gouvernance des donn\u00e9es<\/strong> la d\u00e9finition des r\u00f4les et des responsabilit\u00e9s en mati\u00e8re de gestion de l'information.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2244\" data-end=\"2616\">Dans ce contexte, le <strong data-start=\"2267\" data-end=\"2318\">coop\u00e9ration entre HR et le d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es<\/strong> est d\u00e9terminant : le premier doit veiller \u00e0 la bonne mise en \u0153uvre des principes d'\u00e9quit\u00e9 et de transparence, le second doit s'assurer que les m\u00e9thodes de reporting sont conformes aux principes du GDPR, par exemple en appliquant les principes du <strong data-start=\"2547\" data-end=\"2593\">les analyses d'impact (DPIA, art. 35 GDPR)<\/strong> dans les cas les plus d\u00e9licats.<\/p>\n<p data-start=\"2618\" data-end=\"2899\">La <strong data-start=\"2621\" data-end=\"2641\">Directive 970\/23<\/strong>lue en parall\u00e8le avec la <strong data-start=\"2669\" data-end=\"2677\">GDPR<\/strong>offre un cadre qui peut favoriser non seulement la <strong data-start=\"2724\" data-end=\"2744\">l'\u00e9galit\u00e9 entre les hommes et les femmes<\/strong>mais aussi une plus grande solidit\u00e9 <strong data-start=\"2770\" data-end=\"2816\">culture de la responsabilit\u00e9 organisationnelle<\/strong>dans lequel le <strong data-start=\"2827\" data-end=\"2863\">droits individuels et collectifs<\/strong> sont prot\u00e9g\u00e9s de mani\u00e8re synergique.<\/p>\n<p data-start=\"2901\" data-end=\"3237\">Le d\u00e9fi consiste donc \u00e0 <strong data-start=\"2929\" data-end=\"2969\">trouver un nouveau point d'\u00e9quilibre<\/strong>. Dans ce processus, il est essentiel que les organisations disposent d'un syst\u00e8me de gestion de la qualit\u00e9. <strong data-start=\"3045\" data-end=\"3101\">un ensemble de donn\u00e9es toujours actualis\u00e9es, coh\u00e9rentes et fiables<\/strong> et qu'ils se dotent d'un syst\u00e8me capable de g\u00e9rer avec souplesse l'\u00e9quilibre entre le besoin de transparence et la protection de la vie priv\u00e9e.<\/p>\n<p data-start=\"3239\" data-end=\"3589\">Dans cette perspective, <strong data-start=\"3260\" data-end=\"3271\">Alveria<\/strong> peut soutenir les entreprises en leur
