{"id":2097,"date":"2025-09-30T14:27:39","date_gmt":"2025-09-30T14:27:39","guid":{"rendered":"https:\/\/www.alveria.it\/?p=2097"},"modified":"2025-09-30T14:29:11","modified_gmt":"2025-09-30T14:29:11","slug":"la-directiva-970-23-sobre-transparencia-salarial-y-proteccion-de-datos-un-equilibrio-necesario-2097","status":"publish","type":"post","link":"https:\/\/www.alveria.it\/espanol\/2025\/09\/30\/direttiva-970-23-sulla-trasparenza-retributiva-e-protezione-dei-dati-un-bilanciamento-necessario-2097\/","title":{"rendered":"Directiva 970\/23 sobre transparencia salarial y protecci\u00f3n de datos: un equilibrio necesario"},"content":{"rendered":"<p data-start=\"110\" data-end=\"685\">La <strong data-start=\"113\" data-end=\"140\">Directiva (UE) 970\/23<\/strong> introduce obligaciones estrictas en materia de <strong data-start=\"185\" data-end=\"212\">transparencia salarial<\/strong>con el objetivo de <strong data-start=\"233\" data-end=\"262\">reducir las diferencias salariales entre hombres y mujeres<\/strong> e <strong data-start=\"265\" data-end=\"317\">reforzar el derecho a la igualdad de trato<\/strong>. Entre las principales innovaciones se encuentra el <strong data-start=\"352\" data-end=\"452\">derecho de los trabajadores a recibir informaci\u00f3n sobre los niveles salariales medios, desglosados por sexo<\/strong>para categor\u00edas de trabajadores que realizan el mismo trabajo o un trabajo de igual valor (<strong data-start=\"540\" data-end=\"550\">Art\u00edculo 7<\/strong>), y el<strong data-start=\"557\" data-end=\"671\">obligaci\u00f3n para los empresarios con al menos 100 empleados de elaborar informes peri\u00f3dicos sobre igualdad de retribuci\u00f3n<\/strong> (<strong data-start=\"673\" data-end=\"683\">Art\u00edculo 9<\/strong>).<\/p>\n<p data-start=\"687\" data-end=\"1349\">Sin embargo, estas obligaciones plantean importantes cuestiones con respecto al marco de la <strong data-start=\"769\" data-end=\"802\">protecci\u00f3n de datos personales<\/strong>regido por el <strong data-start=\"821\" data-end=\"857\">Reglamento (UE) 2016\/679 (GDPR)<\/strong>. De hecho, la divulgaci\u00f3n de los datos salariales puede dar lugar a <strong data-start=\"919\" data-end=\"949\">riesgos de identificabilidad<\/strong>especialmente en contextos empresariales de <strong data-start=\"989\" data-end=\"1011\">peque\u00f1o tama\u00f1o<\/strong> o en el <strong data-start=\"1018\" data-end=\"1051\">funciones muy especializadas<\/strong>. En estos casos, la combinaci\u00f3n de variables (<strong data-start=\"1097\" data-end=\"1134\">funci\u00f3n, departamento, sexo, antig\u00fcedad<\/strong>) podr\u00eda hacer reconocibles a los trabajadores individuales, lo que podr\u00eda entrar en conflicto con los principios de <strong data-start=\"1240\" data-end=\"1289\">minimizaci\u00f3n (Art. 5(1)(c) GDPR)<\/strong> e <strong data-start=\"1292\" data-end=\"1348\">limitaci\u00f3n de la finalidad (Art. 5(1)(b))<\/strong>.<\/p>\n<p data-start=\"1351\" data-end=\"1831\">La propia Directiva reconoce la necesidad de equilibrio: la<strong data-start=\"1414\" data-end=\"1425\">Art\u00edculo 19<\/strong> especifica de hecho que las obligaciones de transparencia deben aplicarse <strong data-start=\"1498\" data-end=\"1601\">\"respetando el derecho a la protecci\u00f3n de datos personales establecido en el Reglamento (UE) 2016\/679\".<\/strong>. Esto implica un doble compromiso para los empresarios: <strong data-start=\"1658\" data-end=\"1714\">garantizar el derecho a la informaci\u00f3n de los trabajadores<\/strong> y, al mismo tiempo, <strong data-start=\"1731\" data-end=\"1830\">aplicar medidas de protecci\u00f3n adecuadas para evitar la difusi\u00f3n indebida de datos identificables<\/strong>.<\/p>\n<p data-start=\"1833\" data-end=\"1880\">Las medidas pr\u00e1cticas incluyen:<\/p>\n<ul data-start=\"1882\" data-end=\"2242\">\n<li data-start=\"1882\" data-end=\"1951\">\n<p data-start=\"1884\" data-end=\"1951\"><strong data-start=\"1884\" data-end=\"1924\">Anonimizaci\u00f3n o seudonimizaci\u00f3n<\/strong> de los conjuntos de datos salariales;<\/p>\n<\/li>\n<li data-start=\"1952\" data-end=\"2062\">\n<p data-start=\"1954\" data-end=\"2062\"><strong data-start=\"1954\" data-end=\"1985\">Umbrales m\u00ednimos de numerosidad<\/strong> en los informes, evitando publicaciones en las que el grupo sea demasiado peque\u00f1o;<\/p>\n<\/li>\n<li data-start=\"2063\" data-end=\"2134\">\n<p data-start=\"2065\" data-end=\"2134\"><strong data-start=\"2065\" data-end=\"2103\">Agregaci\u00f3n por rango salarial<\/strong> en lugar de la divulgaci\u00f3n oportuna;<\/p>\n<\/li>\n<li data-start=\"2135\" data-end=\"2242\">\n<p data-start=\"2137\" data-end=\"2242\"><strong data-start=\"2137\" data-end=\"2166\">Pol\u00edtica de gobernanza de datos<\/strong> definici\u00f3n de funciones y responsabilidades en la gesti\u00f3n de la informaci\u00f3n.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2244\" data-end=\"2616\">En este contexto, el <strong data-start=\"2267\" data-end=\"2318\">cooperaci\u00f3n entre HR y el responsable de la protecci\u00f3n de datos<\/strong> es decisivo: el primero debe garantizar la correcta aplicaci\u00f3n de los principios de imparcialidad y transparencia, el segundo debe garantizar que los m\u00e9todos de notificaci\u00f3n cumplen los principios del RGPD, por ejemplo aplicando <strong data-start=\"2547\" data-end=\"2593\">evaluaciones de impacto (DPIA, Art. 35 GDPR)<\/strong> en los casos m\u00e1s delicados.<\/p>\n<p data-start=\"2618\" data-end=\"2899\">La <strong data-start=\"2621\" data-end=\"2641\">Directiva 970\/23<\/strong>leer en paralelo con el <strong data-start=\"2669\" data-end=\"2677\">GDPR<\/strong>ofrece un marco que puede fomentar no s\u00f3lo la <strong data-start=\"2724\" data-end=\"2744\">igualdad entre hombres y mujeres<\/strong>sino tambi\u00e9n una <strong data-start=\"2770\" data-end=\"2816\">cultura de responsabilidad organizativa<\/strong>en la que el <strong data-start=\"2827\" data-end=\"2863\">derechos individuales y colectivos<\/strong> se protegen de forma sin\u00e9rgica.<\/p>\n<p data-start=\"2901\" data-end=\"3237\">Por tanto, el reto consiste en <strong data-start=\"2929\" data-end=\"2969\">encontrar un nuevo punto de equilibrio<\/strong>. En este proceso, es crucial que las organizaciones cuenten con un <strong data-start=\"3045\" data-end=\"3101\">un conjunto de datos siempre actualizados, coherentes y fiables<\/strong> y que se doten de un sistema capaz de gestionar con flexibilidad el equilibrio entre la necesidad de transparencia y la protecci\u00f3n de la intimidad.<\/p>\n<p data-start=\"3239\" data-end=\"3589\">Desde esta
