{"id":2097,"date":"2025-09-30T14:27:39","date_gmt":"2025-09-30T14:27:39","guid":{"rendered":"https:\/\/www.alveria.it\/?p=2097"},"modified":"2025-09-30T14:29:11","modified_gmt":"2025-09-30T14:29:11","slug":"directive-970-23-on-pay-transparency-and-data-protection-a-necessary-balancing-act-2097","status":"publish","type":"post","link":"https:\/\/www.alveria.it\/english\/2025\/09\/30\/direttiva-970-23-sulla-trasparenza-retributiva-e-protezione-dei-dati-un-bilanciamento-necessario-2097\/","title":{"rendered":"Directive 970\/23 on pay transparency and data protection: a necessary balancing act"},"content":{"rendered":"<p data-start=\"110\" data-end=\"685\">La <strong data-start=\"113\" data-end=\"140\">Directive (EU) 970\/23<\/strong> introduces stringent obligations regarding <strong data-start=\"185\" data-end=\"212\">pay transparency<\/strong>with the aim of <strong data-start=\"233\" data-end=\"262\">reduce the gender pay gap<\/strong> and <strong data-start=\"265\" data-end=\"317\">strengthening the right to equal treatment<\/strong>. Among the main innovations is the <strong data-start=\"352\" data-end=\"452\">workers' right to receive information on average wage levels, broken down by gender<\/strong>for categories of workers doing the same work or work of equal value (<strong data-start=\"540\" data-end=\"550\">Article 7<\/strong>), and the<strong data-start=\"557\" data-end=\"671\">obligation for employers with at least 100 employees to prepare periodic equal pay reports<\/strong> (<strong data-start=\"673\" data-end=\"683\">Article 9<\/strong>).<\/p>\n<p data-start=\"687\" data-end=\"1349\">However, these obligations raise important questions in relation to the framework of the <strong data-start=\"769\" data-end=\"802\">personal data protection<\/strong>governed by the <strong data-start=\"821\" data-end=\"857\">Regulation (EU) 2016\/679 (GDPR)<\/strong>. In fact, the disclosure of salary data can lead to <strong data-start=\"919\" data-end=\"949\">identifiability risks<\/strong>especially in corporate contexts of <strong data-start=\"989\" data-end=\"1011\">small size<\/strong> or in the <strong data-start=\"1018\" data-end=\"1051\">highly specialised roles<\/strong>. In such cases, the combination of variables (<strong data-start=\"1097\" data-end=\"1134\">role, department, gender, seniority<\/strong>) could make individual workers recognisable, potentially conflicting with the principles of <strong data-start=\"1240\" data-end=\"1289\">minimisation (Art. 5(1)(c) GDPR)<\/strong> and <strong data-start=\"1292\" data-end=\"1348\">purpose limitation (Art. 5(1)(b))<\/strong>.<\/p>\n<p data-start=\"1351\" data-end=\"1831\">The Directive itself recognises the need for balance: the<strong data-start=\"1414\" data-end=\"1425\">Article 19<\/strong> specifies in fact that transparency obligations must be implemented <strong data-start=\"1498\" data-end=\"1601\">\"respecting the right to the protection of personal data as laid down in Regulation (EU) 2016\/679\".<\/strong>. This implies a twofold commitment for employers: <strong data-start=\"1658\" data-end=\"1714\">guarantee workers' right to information<\/strong> and, at the same time, <strong data-start=\"1731\" data-end=\"1830\">apply appropriate protective measures to prevent the undue dissemination of identifiable data<\/strong>.<\/p>\n<p data-start=\"1833\" data-end=\"1880\">Practical measures include:<\/p>\n<ul data-start=\"1882\" data-end=\"2242\">\n<li data-start=\"1882\" data-end=\"1951\">\n<p data-start=\"1884\" data-end=\"1951\"><strong data-start=\"1884\" data-end=\"1924\">Anonymisation or pseudonymisation<\/strong> of salary datasets;<\/p>\n<\/li>\n<li data-start=\"1952\" data-end=\"2062\">\n<p data-start=\"1954\" data-end=\"2062\"><strong data-start=\"1954\" data-end=\"1985\">Minimum numerosity thresholds<\/strong> in reports, avoiding publications where the group is too small;<\/p>\n<\/li>\n<li data-start=\"2063\" data-end=\"2134\">\n<p data-start=\"2065\" data-end=\"2134\"><strong data-start=\"2065\" data-end=\"2103\">Aggregation by salary range<\/strong> rather than timely disclosure;<\/p>\n<\/li>\n<li data-start=\"2135\" data-end=\"2242\">\n<p data-start=\"2137\" data-end=\"2242\"><strong data-start=\"2137\" data-end=\"2166\">Data governance policy<\/strong> defining roles and responsibilities in information management.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2244\" data-end=\"2616\">In this context, the <strong data-start=\"2267\" data-end=\"2318\">cooperation between HR and Data Protection Officer<\/strong> is decisive: the former must ensure the proper implementation of the principles of fairness and transparency, the latter must ensure that reporting methods comply with the principles of the GDPR, for instance by applying <strong data-start=\"2547\" data-end=\"2593\">impact assessments (DPIA, Art. 35 GDPR)<\/strong> in the most delicate cases.<\/p>\n<p data-start=\"2618\" data-end=\"2899\">La <strong data-start=\"2621\" data-end=\"2641\">Directive 970\/23<\/strong>read in parallel with the <strong data-start=\"2669\" data-end=\"2677\">GDPR<\/strong>offers a framework that can foster not only the <strong data-start=\"2724\" data-end=\"2744\">gender equality<\/strong>but also a more solid <strong data-start=\"2770\" data-end=\"2816\">culture of organisational responsibility<\/strong>in which the <strong data-start=\"2827\" data-end=\"2863\">individual and collective rights<\/strong> are protected in a synergetic manner.<\/p>\n<p data-start=\"2901\" data-end=\"3237\">The challenge is therefore to <strong data-start=\"2929\" data-end=\"2969\">finding a new balance point<\/strong>. In this process, it is crucial that organisations have a <strong data-start=\"3045\" data-end=\"3101\">always up-to-date, consistent and reliable data set<\/strong> and that they equip themselves with a system capable of flexibly managing the balance between the need for transparency and the protection of privacy.<\/p>\n<p data-start=\"3239\" data-end=\"3589\">In this perspective, <strong
