Zu den wichtigsten Neuerungen geh\u00f6rt die <strong data-start=\"352\" data-end=\"452\">das Recht der Arbeitnehmer, Informationen \u00fcber das durchschnittliche Lohnniveau, aufgeschl\u00fcsselt nach Geschlecht, zu erhalten<\/strong>f\u00fcr Kategorien von Arbeitnehmern, die die gleiche oder eine gleichwertige Arbeit verrichten (<strong data-start=\"540\" data-end=\"550\">Artikel 7<\/strong>), und die<strong data-start=\"557\" data-end=\"671\">Verpflichtung f\u00fcr Arbeitgeber mit mindestens 100 Besch\u00e4ftigten zur Erstellung regelm\u00e4\u00dfiger Berichte zur Entgeltgleichheit<\/strong> (<strong data-start=\"673\" data-end=\"683\">Artikel 9<\/strong>).<\/p>\n<p data-start=\"687\" data-end=\"1349\">Diese Verpflichtungen werfen jedoch wichtige Fragen in Bezug auf den Rahmen der <strong data-start=\"769\" data-end=\"802\">Schutz personenbezogener Daten<\/strong>unterliegt der <strong data-start=\"821\" data-end=\"857\">Verordnung (EU) 2016\/679 (GDPR)<\/strong>. In der Tat kann die Offenlegung von Gehaltsdaten dazu f\u00fchren <strong data-start=\"919\" data-end=\"949\">Risiken der Identifizierbarkeit<\/strong>insbesondere im Unternehmensumfeld von <strong data-start=\"989\" data-end=\"1011\">geringe Gr\u00f6\u00dfe<\/strong> oder in der <strong data-start=\"1018\" data-end=\"1051\">hochspezialisierte Aufgaben<\/strong>. In solchen F\u00e4llen wird die Kombination von Variablen (<strong data-start=\"1097\" data-end=\"1134\">Rolle, Abteilung, Geschlecht, Dienstalter<\/strong>) k\u00f6nnten einzelne Arbeitnehmer erkennbar machen, was m\u00f6glicherweise mit den Grunds\u00e4tzen der <strong data-start=\"1240\" data-end=\"1289\">Minimierung (Art. 5(1)(c) GDPR)<\/strong> e <strong data-start=\"1292\" data-end=\"1348\">Zweckbindung (Art. 5(1)(b))<\/strong>.<\/p>\n<p data-start=\"1351\" data-end=\"1831\">In der Richtlinie selbst wird die Notwendigkeit eines Gleichgewichts anerkannt: Die<strong data-start=\"1414\" data-end=\"1425\">Artikel 19<\/strong> legt n\u00e4mlich fest, dass die Transparenzpflichten umgesetzt werden m\u00fcssen <strong data-start=\"1498\" data-end=\"1601\">\"unter Wahrung des Rechts auf den Schutz personenbezogener Daten gem\u00e4\u00df der Verordnung (EU) 2016\/679\".<\/strong>. Dies bedeutet eine doppelte Verpflichtung f\u00fcr die Arbeitgeber: <strong data-start=\"1658\" data-end=\"1714\">das Recht der Arbeitnehmer auf Information zu gew\u00e4hrleisten<\/strong> und, zur gleichen Zeit, <strong data-start=\"1731\" data-end=\"1830\">geeignete Schutzma\u00dfnahmen zu ergreifen, um eine unzul\u00e4ssige Verbreitung von identifizierbaren Daten zu verhindern<\/strong>.<\/p>\n<p data-start=\"1833\" data-end=\"1880\">Zu den praktischen Ma\u00dfnahmen geh\u00f6ren:<\/p>\n<ul data-start=\"1882\" data-end=\"2242\">\n<li data-start=\"1882\" data-end=\"1951\">\n<p data-start=\"1884\" data-end=\"1951\"><strong data-start=\"1884\" data-end=\"1924\">Anonymisierung oder Pseudonymisierung<\/strong> von Gehaltsdatens\u00e4tzen;<\/p>\n<\/li>\n<li data-start=\"1952\" data-end=\"2062\">\n<p data-start=\"1954\" data-end=\"2062\"><strong data-start=\"1954\" data-end=\"1985\">Schwellenwerte f\u00fcr die Mindestanzahl<\/strong> in Berichten, wobei Ver\u00f6ffentlichungen vermieden werden sollten, bei denen die Gruppe zu klein ist;<\/p>\n<\/li>\n<li data-start=\"2063\" data-end=\"2134\">\n<p data-start=\"2065\" data-end=\"2134\"><strong data-start=\"2065\" data-end=\"2103\">Aggregation nach Gehaltsgruppen<\/strong> und nicht die rechtzeitige Offenlegung;<\/p>\n<\/li>\n<li data-start=\"2135\" data-end=\"2242\">\n<p data-start=\"2137\" data-end=\"2242\"><strong data-start=\"2137\" data-end=\"2166\">Politik der Datenverwaltung<\/strong> Festlegung von Rollen und Verantwortlichkeiten im Informationsmanagement.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2244\" data-end=\"2616\">In diesem Zusammenhang ist die <strong data-start=\"2267\" data-end=\"2318\">Zusammenarbeit zwischen HR und dem Datenschutzbeauftragten<\/strong> ist entscheidend: Erstere muss die ordnungsgem\u00e4\u00dfe Umsetzung der Grunds\u00e4tze der Fairness und Transparenz gew\u00e4hrleisten, letztere muss sicherstellen, dass die Berichterstattungsmethoden den Grunds\u00e4tzen der Datenschutz-Grundverordnung entsprechen, beispielsweise durch Anwendung <strong data-start=\"2547\" data-end=\"2593\">Folgenabsch\u00e4tzungen (DPIA, Art. 35 GDPR)<\/strong> in den heikelsten F\u00e4llen.<\/p>\n<p data-start=\"2618\" data-end=\"2899\">La <strong data-start=\"2621\" data-end=\"2641\">Richtlinie 970\/23<\/strong>die parallel zum <strong data-start=\"2669\" data-end=\"2677\">GDPR<\/strong>bietet einen Rahmen, der nicht nur die <strong data-start=\"2724\" data-end=\"2744\">Gleichstellung der Geschlechter<\/strong>sondern auch eine solidere <strong data-start=\"2770\" data-end=\"2816\">Kultur der organisatorischen Verantwortung<\/strong>in denen die <strong data-start=\"2827\" data-end=\"2863\">individuelle und kollektive Rechte<\/strong> auf synergetische Weise gesch\u00fctzt werden.<\/p>\n<p data-start=\"2901\" data-end=\"3237\">Die Herausforderung besteht daher darin <strong data-start=\"2929\" data-end=\"2969\">einen neuen Gleichgewichtspunkt finden<\/strong>.
